Terms of Service
These Terms of Service govern access to the CK Photo website and the booking and delivery of photography services in Iceland. They are intended to provide a clear, professional and transparent framework for enquiries, bookings, image use, payment, cancellation, client responsibilities, privacy-related matters and dispute handling.
Welcome to CK Photo. These Terms of Service (“Terms”) apply to your use of the website located at ckphoto.is and to all enquiries, bookings, communications, photography services, image delivery arrangements and related interactions with CK Photo. By visiting the website, submitting an enquiry form, requesting a quote, booking a session or otherwise engaging CK Photo, you acknowledge that you have read, understood and agreed to be bound by these Terms.
1. Acceptance of Terms
By accessing or using this website, you confirm that you accept these Terms in full. If you do not agree with any provision of these Terms, you must not use this website and must not proceed with an enquiry or booking. If you are acting on behalf of a business, organisation, agency, brand or other legal entity, you confirm that you have authority to bind that entity to these Terms.
CK Photo may provide services to both private individuals and business clients. Certain projects may also be governed by a separate written agreement, quotation, proposal, invoice schedule, production brief or licensing document. Where a separate written agreement expressly overrides part of these Terms, that separate written agreement will control only to the extent of the inconsistency.
2. Business Information
This website is operated under the brand CK Photo, which is a trading name of Direction Iceland ehf., a company registered in Iceland.
For all legal, contractual, invoicing and operational purposes, the contracting party is Direction Iceland ehf., which provides photography services under the CK Photo brand.
3. Website Use
You may use this website only for lawful purposes and in a manner that does not infringe the rights of CK Photo or any third party. You agree not to misuse the website, attempt unauthorised access, distribute malicious code, overload or disrupt site infrastructure, scrape protected content without permission, impersonate another person or submit knowingly false, misleading or fraudulent information.
All website content, including but not limited to text, copy, structure, layout, branding, still images, logos, portfolio selections, graphic treatments and other published materials, is protected by applicable intellectual property laws and may not be copied, reproduced, republished or commercially exploited without prior written consent.
4. Scope of Services
CK Photo provides photography-related services in Iceland, including but not limited to portrait photography, automotive photography, commercial and brand imagery, lifestyle photography, event coverage, creative direction and selected visual content production services. The exact scope of work is determined on a case-by-case basis.
Any description of services on the website is for general information only and does not constitute a binding offer. Final service scope depends on availability, project complexity, location, access conditions, weather, intended usage, production needs, scheduling constraints and the terms set out in the applicable quote, invoice or written confirmation.
5. Booking & Contract Formation
Submission of an enquiry form does not, by itself, create a binding booking. A booking is considered accepted only when CK Photo has confirmed the project in writing and, where required, received any applicable deposit or advance payment.
Prior to confirmation, CK Photo may request further details regarding project objectives, number of participants, location access, usage requirements, schedule, styling, permits, logistics, lighting conditions, weather contingencies, delivery expectations and any other issue reasonably relevant to the work.
CK Photo reserves the right to decline or refuse a booking request, including where the project is not suitable, unsafe, unavailable, legally problematic, inconsistent with brand standards, dependent on unrealistic deadlines, or where requested usage rights, terms or payment expectations cannot be agreed.
6. Pricing, Deposits & Payment
All pricing is quoted individually unless fixed package pricing is expressly published. Quotes may depend on factors such as shooting duration, travel, preparation time, post-production workload, complexity, number of deliverables, licensing scope, urgency, assistants, equipment needs, location access and intended commercial use.
Unless otherwise agreed in writing:
- a booking may require a non-refundable or partially refundable deposit to secure the date;
- the remaining balance may be due before the session, on the session date, or before final delivery;
- commercial usage may require separate licensing fees beyond production fees;
- late payment may delay delivery, release of files or transfer of usage rights;
- additional work outside the agreed scope may be invoiced separately.
All invoices must be paid within the period stated on the invoice. If no period is stated, payment is due within fourteen (14) calendar days from invoice date. CK Photo reserves the right to charge reasonable default interest, collection costs or administrative fees where permitted by applicable law and where payment remains overdue.
7. Consumer Rights & Distance Contracts
Where you book as a consumer and the contract is concluded at a distance, off-premises or through online communication, mandatory consumer protection rules may apply under Icelandic and EEA consumer law. Nothing in these Terms is intended to exclude or reduce any non-waivable consumer rights that apply by law.
If a mandatory right of withdrawal applies to your booking, that right will apply only to the extent required by law. However, where a photography service is scheduled to begin, planning has already started, work has already been performed, or delivery of customised services has commenced with your request or consent, your cancellation rights may be reduced, excluded or subject to proportionate payment for work already carried out, to the extent permitted by law.
8. Cancellation & Rescheduling
If the Client wishes to cancel or reschedule a confirmed booking, the Client must notify CK Photo as early as possible in writing. Because photography services are date-sensitive and may involve opportunity loss, travel planning, weather coordination, equipment preparation and blocked calendar time, CK Photo reserves the right to retain part or all of the deposit depending on timing, preparation already performed and the ability to rebook the reserved date.
Unless a different cancellation schedule is stated in writing for the specific booking, the following framework may apply:
- more than 14 days before the scheduled service date: deposit may be transferable once, subject to availability;
- 7 to 14 days before the scheduled service date: deposit may be retained in whole or in part;
- less than 7 days before the scheduled service date: CK Photo may charge the full deposit and reasonable pre-booked costs;
- same-day cancellation, no-show or unreasonably delayed attendance: CK Photo may treat the session as cancelled by the Client.
CK Photo may reschedule or suspend a shoot where weather, road conditions, safety concerns, illness, force majeure, location restrictions, equipment failure, emergency circumstances or other reasonable factors make performance unsafe, impractical or seriously compromised. Where possible, CK Photo will work with the Client to arrange a new date.
9. Client Responsibilities
The Client is responsible for providing complete and accurate information relevant to the booking. This includes, where applicable, participant details, timing, location, creative expectations, access permissions, permits, approvals, usage plans, special requirements, minors involved in the shoot, transportation expectations and any safety issue that may affect performance.
The Client further agrees:
- to attend on time and be reasonably prepared for the session;
- to obtain permission for any location, property, vehicle, venue or restricted-access area involved in the shoot;
- to ensure that any necessary third-party consents, releases or internal approvals are obtained where needed;
- to behave respectfully and not expose CK Photo to abuse, harassment, unsafe conditions or unlawful instructions;
- to ensure that minors are accompanied and authorised by a parent or legal guardian where required.
CK Photo shall not be responsible for reduced output quality, missed coverage or project delays caused by inaccurate instructions, late arrival, lack of access, weather refusal by participants, missing permissions, location restrictions, poor cooperation, defective props or vehicles, or changing requirements introduced after confirmation.
10. Delivery & Turnaround
Delivery times are estimates unless a guaranteed deadline has been expressly agreed in writing. Turnaround depends on workload, season, project complexity, travel, retouching level, number of selected images, licensing scope and whether client-side approvals are required during the process.
Unless otherwise agreed:
- final images will be delivered in digital format through an online gallery, download link, file transfer service or other agreed method;
- raw or unedited files are not included;
- delivery may be staged, such as preview selection first and final retouched files later;
- archiving after delivery is not guaranteed for any minimum period unless expressly agreed in writing.
The Client is responsible for downloading and safely storing delivered files once provided. CK Photo may delete archived files after a reasonable period and cannot guarantee indefinite retention.
11. Editing & Artistic Discretion
CK Photo retains full artistic discretion in relation to composition, framing, cropping, colour treatment, retouching style, image selection, lighting decisions, post-production workflow and the overall visual approach. The Client acknowledges that the work created by CK Photo reflects an established creative style and that final deliverables may not include every image taken during the session.
Requests for extensive retouching, composite work, removal of large objects, body reshaping, commercial image manipulation, brand-specific formatting or significant re-editing beyond the originally agreed scope may incur additional fees.
12. Copyright & Usage Rights
Unless expressly transferred in a written agreement, all copyright and related intellectual property rights in photographs, previews, edits, exports, drafts and related visual materials remain the sole property of CK Photo.
Upon full payment, the Client receives only the usage rights expressly granted in writing or reasonably implied by the booking type. Personal clients generally receive a non-exclusive, non-transferable licence to use delivered images for personal, non-commercial use. Commercial, editorial, advertising, promotional, resale, publication, paid-media, print-run, licensing, submission to third parties, agency transfer or brand campaign usage requires explicit permission and may require a separate commercial licence.
Unless explicitly permitted in writing, the Client must not:
- sell, sublicense or transfer images to third parties;
- submit images to magazines, publications, brands or platforms for commercial exploitation;
- apply filters or edits that materially distort CK Photo’s work;
- remove metadata, watermarks or credits where included;
- use images in a defamatory, unlawful, misleading or offensive context.
13. Portfolio, Promotion & Publication
Unless otherwise agreed in writing before the session, CK Photo may use commissioned and delivered images, behind-the-scenes materials, approved excerpts and project references for legitimate self-promotional purposes, including portfolio display, website publication, social media, printed materials, awards submissions, pitches, press kits and similar promotional uses.
If the Client requires confidentiality, embargo, non-disclosure, private commissioning, delayed publication or restricted portfolio use, this must be agreed in writing in advance. Additional fees may apply where portfolio restriction materially affects the value of the commission.
14. Third-Party Services
CK Photo may use third-party platforms and providers for hosting, file delivery, communication, invoicing, email handling, analytics, payment processing, scheduling or cloud storage. While CK Photo selects providers in good faith, CK Photo is not responsible for the independent terms, downtime, policies or acts of third-party services beyond CK Photo’s reasonable control.
Use of the website may involve links to external sites or services. Such links are provided for convenience only and do not imply endorsement. CK Photo is not responsible for the content, availability or conduct of any external website.
15. Limitation of Liability
To the maximum extent permitted by applicable law, CK Photo shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of business, loss of profit, reputational harm, missed opportunity, lost data or third-party claims arising out of or related to the use of the website or the provision of services.
CK Photo’s total aggregate liability in connection with any booking, project or claim shall not exceed the total amount actually paid by the Client to CK Photo for the relevant service giving rise to the claim, except where a greater limitation is prohibited by mandatory law.
CK Photo does not guarantee that every desired image, angle, person, moment, weather condition, lighting condition or commercial objective can be achieved. Photography is affected by environment, movement, access, timing, weather, available light and subject cooperation.
16. Force Majeure
CK Photo shall not be deemed in breach of contract or otherwise liable for delay, cancellation, reduced performance or non-performance caused by circumstances beyond reasonable control. Such circumstances include, but are not limited to, severe weather, storms, road closures, volcanic activity, natural disasters, public authority restrictions, strike action, epidemic or pandemic conditions, emergency incidents, utility outage, network outage, transport disruption, venue closure, theft, serious illness or equipment failure not reasonably preventable.
17. Personal Data
CK Photo processes personal data in accordance with applicable Icelandic data protection law and the GDPR framework. Personal data submitted through enquiry forms, e-mail correspondence, booking requests or project communication may include your name, contact details, company information, project details, message content, invoice details and any other information you choose to provide.
This information may be processed for purposes such as responding to enquiries, preparing quotes, managing bookings, communicating about projects, invoicing, delivering files, fulfilling legal obligations, safeguarding legitimate business interests and maintaining service quality.
Where required by law, data will be processed on an appropriate legal basis, including performance of a contract, pre-contractual steps at your request, compliance with legal obligations, consent where applicable, or legitimate interests that do not override your rights.

18. Complaints & Dispute Resolution
CK Photo aims to resolve issues professionally and in good faith. If you believe there has been an error, service failure, invoice issue or misuse of images, you should first contact CK Photo directly in writing and provide a clear description of the matter together with any supporting documents.
If you are a consumer and the dispute cannot be resolved directly, you may have access to official complaint channels or consumer dispute bodies available in Iceland, subject to their jurisdiction and rules. Nothing in these Terms prevents either party from pursuing remedies available under applicable law.
19. Changes to These Terms
CK Photo reserves the right to amend, update or revise these Terms from time to time to reflect changes in law, business practice, website functionality, service offerings, pricing structure, data handling or other operational requirements. The latest version will be published on this page with an updated revision date. Continued use of the website after publication of revised Terms constitutes acceptance of the updated Terms to the extent permitted by law.
20. Governing Law
These Terms and any dispute or claim arising out of or in connection with them, the website or the services of CK Photo shall be governed by and interpreted in accordance with the laws of Iceland, except where mandatory consumer protection provisions require otherwise.
Subject to mandatory law, disputes that cannot be resolved amicably shall be submitted to the competent courts or authorities in Iceland.
